For decades, employers have quietly funneled good American jobs to foreign workers, while keeping the opportunities hidden from U.S. applicants.
H-1B visas do not require employers to prove that no qualified American exists. But when they try to convert an H-1B worker to a Green Card as a reward for being a loyal worker at below-market wages, the law demands a labor market test (PERM) to ensure Americans aren’t being shut out.
Every employer knows the ultimate goal for H-1B workers is obtaining that coveted Green Card. Congress made the H-1B a “dual-intent” visa, which allows employers to use permanent residency as a negotiating tool to secure cheaper labor.
The Department of Labor (DOL)—which administers the Permanent Labor Certification program, known as PERM—should, in theory, have an electronic registry that tracks all PERM job postings, making them transparent for American workers. Instead, the integrity of the process is placed entirely on employers, and the whole system functions on a “trust-me” basis. Naturally, employers are not going to advertise jobs where there are likely to be numerous qualified American applicants. Instead, they hide postings in Sunday newspapers and other obscure places, confident no American will ever see them.
Now, with a new administration, it’s time for a “new sheriff in town.” The DOL has the authority to establish an electronic registry for all PERM job postings through rulemaking, creating the transparency that should have existed all along.
